General terms and conditions of the transaction

In order to place an order via the enquiry form or by e-mail, the buyer must provide the seller with his/her contact details and a description of the goods requested. The seller will then contact the buyer to continue the purchase process (if necessary, to specify the order) and to prepare the invoice.

In order to order goods in the online shop, you must add the desired products to your shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. The amount of the fee is then displayed on the screen and can be paid securely via the bank links displayed in the e-shop.

The payment service provider is the intermediary. Payments are made outside the online shop in a secure environment and by credit card in the secure environment of the payment service provider. The merchant does not have access to the customer's bank and credit card details. The order takes effect from the date of receipt of the amount due in the seller's bank account.

The merchant is the controller of the personal data and forwards the personal data necessary for the execution of payments to a processor, i.e. a payment service provider.

If the goods ordered from the e-shop cannot be delivered due to expiry of the goods or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded immediately, but not later than 14 days after the notification.

In order to pick up the goods ordered from the e-shop, the buyer has the option of ordering the goods from an Omniva, Itella or DPD parcel terminal of their choice or picking up the goods themselves.

The shipping costs are borne by the buyer and the corresponding price information is displayed in the e-shop under the shipping method. The buyer's special requirements regarding the delivery of the goods are agreed separately between the buyer and the seller.

Shipments from an online shop in Estonia usually arrive at the destination specified by the buyer within 7 working days from the date of payment to the seller. Outside Estonia, delivery will take place within 14 calendar days of receipt of payment by the seller.

The delivery time for goods offered outside the online shop, on the seller's website or on the site depends on the content of the order, the order backlog of products currently in production and will be specified with the buyer before the order is confirmed.

For goods offered for delivery outside the online shop, on the seller's website or at the place of business, the buyer can choose either to collect the goods themselves at the seller's business address or to have the delivery carried out by the seller. The cost of delivery is borne by the buyer. This agreement is concluded between the buyer and the seller before the order is confirmed.

If the buyer orders delivery of the goods from the seller, the seller's freight forwarder-consultant will deliver the goods to the agreed address within Estonia. The goods will be delivered on a light trailer, packed horizontally. Transport does not include unloading or lifting services. Manual unloading requires a total of at least three adults of average physical fitness and is the responsibility of the buyer. Outside Estonia, the seller may use the services of a local partner for delivery. In such cases, this will be specified before the order is confirmed with the buyer.

If the buyer needs a crane service when unloading the goods, he/she will inform the seller before confirming the order. The crane service will be organised either by the buyer or by the seller as agreed. The buyer pays for the crane service.

The right of withdrawal provided for in § 56 of the LOA does not apply in the cases provided for in § 53(4) of the LOA. In particular (without prejudice to the other grounds provided for in Section 53(4) of the LOA), the buyer does not have the right to withdraw from the transaction in the case of goods which have been manufactured taking into account the buyer's personal needs or in accordance with the conditions provided by the buyer.

After receipt of the order, the buyer has the right to withdraw from the purchase of goods ordered from the online shop within 14 days.

In order to exercise the 14-day right of withdrawal, goods ordered from an online shop may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the same way as is allowed for testing the goods in a physical shop.

In order to return goods ordered from the online store, you must submit a withdrawal form and send it to info@welvaere.ee within 14 days of receipt of the goods.

The buyer must return the goods to the seller within 14 days of the date of the application or prove that he has handed them over to the carrier within that period.

Upon receipt of the goods to be returned, the Seller shall return to the Buyer without undue delay, but no later than 14 days after receipt of the withdrawal, all fees received from the Buyer under the e-commerce transaction.

The seller may refuse a refund until it has received the goods ordered from the e-shop back from the buyer or until the buyer has proved that it has returned the goods, whichever is the earlier.

If the buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the seller in the online shop, the seller does not have to refund the consumer the cost of the delivery method that exceeds the cost of the usual delivery method.

If the goods ordered from the online shop have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods, or show signs of use or wear, the seller is entitled to reduce the refundable amount in proportion to the depreciation of the goods.

The seller has the right to withdraw from the sale and to demand the return of the goods from the buyer if the price of the goods in the online shop has been marked significantly below the market price of the goods due to a mistake.

The right of withdrawal does not apply if the buyer is a legal person.

The 14-day right of withdrawal does not apply if the buyer makes any purchase on the seller's premises.

The seller shall be liable for any non-conformity or defect in the goods sold to a private buyer which was already present at the time of delivery and which becomes apparent within a period of up to two years from the delivery of the goods to the buyer. During the first six months after the delivery of the goods to the buyer, the defect shall be presumed to have existed at the time of delivery. It is the seller's responsibility to rebut this presumption.

The right of complaint also applies to goods offered for sale outside the seller's online shop, on the seller's website, and goods purchased on the seller's premises.

In the event of a defect, the buyer has the right to contact the seller within two months at the latest by sending an e-mail to info@lingalaid.ee.

The Seller shall not be liable for any defects that have occurred after the goods have been delivered to the Buyer.

If the purchased goods have defects for which the seller is responsible, the seller will repair or replace the defective goods. If it is not possible to repair or replace the goods, the seller will refund to the buyer all the charges for the sale of the goods.

The seller shall reply to the buyer's complaint in writing or in a form which can be reproduced in writing within 15 days.

The Seller will use the Buyer's personal data only for the purpose of processing the order and sending the goods to the Buyer. If necessary, the Seller will forward the personal data to the company providing the transport service in order to arrange the delivery of the goods.

These General Terms and Conditions of the Transaction and the sale and purchase transactions entered into on the basis of them shall be governed by the law of the Republic of Estonia.

All complaints from the buyer to the seller should be sent to info@lingalaid.ee.

Where the seller has the right or the obligation to send information or documents to the buyer by e-mail, the buyer shall be solely responsible for the transmission to the seller of a valid e-mail address belonging to the buyer in all the cases set out in the General Conditions.

All disputes arising in connection with these General Terms and Conditions and the transactions entered into hereunder shall be settled by negotiation. If no agreement can be reached, disputes shall be settled by the Consumer Disputes Committee or the courts of the Republic of Estonia.
